Kalshi has nationwide approval from the Commodity Futures Trading Commission, or CFTC, to offer prediction markets. That means the platform is regulated at the federal level, not state by state, like sportsbooks.
On Kalshi, users trade contracts based on sports and other real-world outcomes, including politics, economics, and mentions markets. Contract prices shift as traders buy and sell based on what they expect to happen next.
Several states have challenged Kalshi, arguing its sports contracts were really unlicensed sports betting.
Below is a state-by-state look at those disputes.
- Arizona: Arizona filed criminal charges against Kalshi. A federal judge later paused that case and temporarily blocked the state from enforcing its gambling laws against the company while the larger legal fight continues.
- Illinois: Illinois issued a cease-and-desist and argued that Kalshi’s sports contracts fall under state gambling law, not just federal market regulation. The state later became part of the broader federal litigation over prediction market oversight.
- Maryland: Maryland regulators sent Kalshi a cease-and-desist in April 2025 and said the contracts were “indistinguishable” from sports wagers under state law. Kalshi sued, but the court denied its request for a preliminary injunction.
- Massachusetts: Massachusetts sued Kalshi directly rather than stopping at a cease-and-desist. In January 2026, the state won a preliminary injunction blocking Kalshi from offering sports contracts there unless it complies with the Massachusetts sports gaming law.
- Montana: Kalshi and Montana reached a temporary non-enforcement arrangement in 2025. That changed in 2026, when Montana sent another cease-and-desist, and Kalshi responded with a new federal lawsuit.
- Nevada: In March 2025, the Nevada Gaming Control Board sent Kalshi a cease-and-desist and said its sports and election contracts were illegal in the state unless offered through Nevada’s licensed gaming system. Nevada later won court rulings allowing it to keep enforcing that position.
- New Jersey: New Jersey sent Kalshi a cease-and-desist after the company launched sports contracts. Kalshi sued in federal court and won a preliminary injunction, which blocked the state from enforcing its order for the time being.
- Ohio: Ohio regulators treated Kalshi’s sports contracts as illegal sports betting and took action against the company. They later sought a $5 million fine.
